We have many employees who move from casual to perm employees and sometimes even back to casual. The leave is applied from start date if there is a new leave type applied but you cant unapply it. ie. no end date. so if they move back to casual the sick leave continues to accrue.
Also we have difference EBA contracts which have different leave types. When employees move back and forth JPC recalulate what the accrued annual leave and sick leave hour balance with the new leave type should be. The amount accrued on the previous contract should be able to stay at that employee payroll rate as they are not obliged to have all there leave paid out due to a contract amendment. This also affects our RDO's.
In essence, leave should be linked to the pay rate at which it was earned at.
